Terms and Conditions summary

We have set out a summary of the Terms and Conditions for the Kaleidoscope Program for ease. However, and before you submit your Story to Kaleidoscope you will need to confirm that you have read and understood the full Terms and Conditions of Participation to Kaleidoscope (available below)

Purpose of the Project

Kaleidoscope is collecting written submissions from Jews in Europe illustrating their experience of engagement in and with Jewish life in contemporary times (a “Story”, or “Stories”).

Stories will be published on a dedicated website, and may be included in archive and other collections for research into contemporary European Jewish life and other purposes.

Eligibility

Stories are invited from individual people who

• Identify as Jewish
• live in Europe

An individual can submit only one Story to Kaleidescope.

Content of the Story

The content of the Story should focus on one or more aspects of the writer’s experience of their Jewish life, and must not contain anything that is likely to cause offence or harm.

The Terms and Conditions provide suggested Content Guidelines which are available here

A Story must be an original piece of work, written by the writer who is submitting it on the Kaleidoscope website.

A Story may have been published elsewhere before submission to Kaleidoscope, provided the writer has retained rights in the Story and can therefore comply with the Terms and Conditions of Participation in Kaleidoscope.

The Stories can be accompanied by visual representations (which can be provided in any media), up to a maximum of 25MB storage.

Kaleidoscope will have the right to make edits to a Story to make it fit for the Website, including correction of typos and small errors.

Language and presentation

A Story may be submitted in any European language. Where stories are not submitted in English, you will be asked to submit a translated version of the story using either Deepl, Chat GPT or Google Translate.

Closing date for entries

Entries will be considered on a rolling basis.

If Kaleidoscope decide to publish your Story:

Kaleidoscope will include the writer’s name as the author of the Story, unless the writer requests anonymity on the Submission Form.

Kaleidoscope will be entitled to publish any submitted Story, or excerpts from it, in any and all media, and include excerpts for marketing or other purposes, including on social media.

Kaleidoscope may store the Story in any archive or other platform that it may from time to time decide.

The writer of any Story can continue to publish the Story elsewhere, provided that publication or other use of the Story does not interfere with the rights granted by the writer to Kaleidoscope under the Terms and Conditions of Participation.

Removal of Stories

A writer may choose to withdraw their Story at any time by sending notice to Kaleidoscope. Where a request for withdrawal is received by Kaleidoscope, if the Story has already been published on the Kaleidoscope website and/or elsewhere, Kaleidoscope we will endeavour to remove it from any media as quickly as possible.

Kaleidoscope may refuse to include or remove any submitted Story from publication on any or all media, at any time at its sole discretion.

Payment and Prizes

Kaleidoscope may decide to award prizes to one or more stories.

Awards of prizes are at the sole discretion of Kaleidoscope and may require the authors of the Stories for which prizes have been awarded to attend events, subject to further agreement.

 

Introduction

The Kaleidoscope project aims to collect autobiographies from Jews in Europe, showing their engagement in and with Jewish life, through their own written words and visual illustrations. With this range of authentic experiences, the Rothschild Foundation Hanadiv Europe hopes to create a record of the diverse, reflective, and collective experience of Jews from across Europe in the first half of the twenty first century.

Kaleidoscope autobiographies will provide a historic record and might serve as a primary source for future academic research.

Entries to Kaleidoscope are invited from people who fulfil the following criteria:

- Identify as Jewish

- live in Europe

Entries should be in the form of a written story of between 750 and 7500 words. The stories can be accompanied by visual representations which could be provided in any media.

 

Terms and Conditions

1 - About Kaleidoscope

is a project (“Kaleidoscope” or “the Kaleidoscope Project”) created, launched and administered by The Rothschild Foundation Hanadiv Europe, (referred to as “RFHE”, or “us”, or “our” or “we”). The purpose of the Project is to offer a space online and in other media for Jews from Europe to express their authentic experiences and thoughts, through their own written autobiographies (“the Story” or “the Stories”). The Stories will be published as a contemporary record of their experiences.

 

2 - Eligibility

2.1 To submit a Story to Kaleidoscope, you should identify as Jewish. Entries are invited from residents of any country in Europe.

2.2 Stories will be submitted by individuals (“you”, “candidates”) and no individual can submit more than one entry. The Story must be wholly written by you, and you guarantee that the Story contains no material created or otherwise owned by any other party.

2.3 The Story should relate to your experience as a Jewish person, and should incorporate your responses to the areas set out in the Kaleidoscope Content Guidelines (see Appendix 1).

 

3 - How to participate

3.1 You need to register to participate.

3.2 After registration, you will receive instructions and a link to submit your story and attachments through the Story Submission Form.

3.3 Entries are received on a rolling basis.

3.4 As part of the registration, you will be asked to provide your email address, your phone number, your name and surname and date of birth. You will be asked to provide optional information that might be published with your consent. We will also ask for any other addresses you may use on social media, including but not limited to your Instagram handle, all of which will only be published subject to your agreement in accordance with clauses 3.5 and 3.6.

3.5 You will have the option to publish the story anonymously under a pseudonym, but any story will only be considered and included in the Project subject to your provision to us of the details set out in clause 3.4.

3.6 The details requested in clause 3.4 will be kept private and confidential by us, in accordance with Kaleidoscope’s Privacy and Data Protection Notice (see Appendix 2) unless you give your express permission on the Story Submission Form for these details to be published.

3.7 When you submit your Story, you will be required to confirm your agreement to these Terms and Conditions. You will receive an automated acknowledgement of the submission, which will also confirm your agreement to these Terms and Conditions.

3.8 There is no charge for submission, and RFHE will not pay you anything for your submission. If your Story is published as part of the Kaleidoscope project in accordance with these Terms and Conditions, RFHE may send you a small gift of monetary value of no more than £30, as a token of your participation.

3.9 You can submit only one Story. If you submit more than one Story to us, only the first Story will be considered, except in extenuating circumstances, as may be agreed between you and RFHE.

3.10 Entries to Kaleidoscope cannot be returned, so please keep a copy for your records.

3.11 Your submission is final. We will confirm all details with you prior to publication, but, for the avoidance of doubt we will not accept any corrections or alterations to the content of your Story after it is initially submitted.

3.12 If we decide to publish your Story on the Kaleidoscope website or elsewhere, we will use all reasonable endeavours to notify you.

3.13 You agree that you consent to publish and store your Story on the Kaleidoscope website and in the archive and that we might use quotes from your story and your pictures for promoting the project on the website or in any other media, including social media.

3.14 From time to time, we may ask you to share your Story on your social media channels and you will use all reasonable endeavours to support us in any such sharing, unless you have chosen anonymity.

3.15 You are entitled to withdraw your Story at any time in accordance with the terms as set out in clause 10.

 

4 - The Story

4.1 Stories may be written and submitted in any European language (including

Hebrew and Yiddish), and RFHE will have the right, in accordance with paragraph 5.5 to make minor edits prior to publishing the Story as we think necessary.

4.2 Where your story is written in a language other than English, you will be asked to submit both the English and the original language versions. As part of your submission, we will ask you to identify and include the name of the translation tool used. If you do not submit an English version, we will translate it using a translation tool like Deepl, ChatGPT or Google translate and will state that it has been automatically translated through AI.

4.3 The English version of the submitted Story must be between 750 and 7500 words in length and align with the Kaleidoscope Content Guidelines (see Appendix 1).

4.4 You are welcome to include some visual representations with your Story, which could be in the form of pictures, video or any other visual representation you choose that can be represented electronically (requiring up to 25 MB online storage).

4.5 Any submitted Story that is shorter than 750 words or longer than 7500 words might not be considered for inclusion in the Project.

4.6 Stories should be submitted as an editable document.

4.7 As set out in clause 2.2, the submitted Story must be an original piece of work by you. The Story may have been published or submitted for publication elsewhere, provided that you retain all underlying rights in the Story, and the Story is not assigned, and has not previously been assigned to any other party, nor contain any material or any intellectual property rights which are or may be the property of any other party except you. Anecdotes can feature well known public figures from present day or from history or use real-life experiences as a creative springboard, provided the Story that you submit is an original work by you.

4.8 We intend to publish and showcase the Stories in English and other languages on a dedicated Kaleidoscope website (“the Website”). From time to time, RFHE might also decide to display some or all of the Stories in other places and in other media or in collaboration with other media outlets, which will be at the discretion of RFHE.

4.9 You confirm that:

4.9.1 the Story is wholly original to you and the use of the Story by RFHE, including downloading, copying and using the Story as set out in these Terms and Conditions, will not infringe any rights of any third parties including but not limited to the copyright, patent, trademark or trade secret rights;

4.9.2 the Story (and/or its electronic version) does not contain and will not install any viruses, worms, malware, Trojan horses or other harmful or destructive content, whether electronic or otherwise;

4.9.3 where the Story contains any material that is in any way machine or randomly generated, including being created by any artificial intelligence program, you will include explanations and references in the submission form; and

4.9.4 the content of the Story and any communications that you may control around the Story, does not contain unethical content of any nature; is not in any way pornographic, does not contain threats or incite violence, and does not defame or otherwise infringe or violate privacy or publicity rights of RFHE or any third party.

 

5 - Licence of Rights

5.1 By submitting the Story to us, and subject always to your rights under clause 10.1, you grant us and any of our partners or licensees of whatever nature, a perpetual non-exclusive royalty-free licence to

(a) publish and use the Story in all media, including but not limited to, to perform, publish, broadcast, podcast and post the Story online and on any other platforms and on platforms yet to be envisaged, in the language in which you submitted it, as well as in any translation (where such translation is performed electronically); and

at any time to store the Story or any part of it in any relevant digital or physical archive in perpetuity or for as long as we choose, including but not limited to inclusion in the Central Archives of the History of the Jewish People (“CAHJP”), which is part of the National Library of Israel, subject to the terms of the CAHJP in Appendix 3 below.

5.2. Where you choose to include any visuals with your Story, where those visuals include pictures or material that involve any third parties, you confirm that those third parties have given full permission for their likeness or any other use to be used in accordance with this Agreement. If requested by you, we will provide you with a form for the third parties to sign.

5.3 This licence will be deemed to include all the necessary rights and permissions to enable use by RFHE, and to complete the administration of the Project, including editing the story as described in clause 5.4 below and uploading and publishing your Story on the Kaleidoscope website and on any other media as we may from time to time decide are appropriate, and the storage retention of the Story in an archive or other facility as set out in clause 5.1.

5.4 The rights of publication as set out in these terms will be non-exclusive, and you are entitled to publish your Story elsewhere and in any other media, subject only to the non-interference of the rights granted to RFHE as set out in clause 5.1 and 5.2 and the other Terms and Conditions.

5.5 The writer retains the moral right to be identified as the author of their Story, and will be identified as the author unless otherwise requested by the author as set out in clause 6.2.

5.6 By submitting a Story, you agree that RFHE, may in its sole discretion edit, adapt or abridge your Story for the sole purposes of making it fit for the Website. Where we edit your Story in any way beyond simple correction of typos and small errors, we will endeavour to revert to you to confirm the changes with you, but you agree that our failure to do so will not constitute any breach of our obligations hereunder.

5.7 From time to time, RFHE may choose to award participation token or content prizes to any person who submits a Story that RFHE chooses to publish. For the avoidance of doubt, and unless otherwise agreed, the award of such participation token confers confirmation of your submission of a Story to RFHE and participation in the Kaleidoscope Project, but does not represent confirmation of publication on the Kaleidoscope Website.

5.8 Publication of your Story on the Kaleidoscope Website will be at the discretion of RFHE at all times unless permission to publish is withdrawn by you in accordance with this Agreement.

 

6 - Attribution and Anonymity

6.1 Where you request that your Story be published anonymously in accordance with clause 3.5, we will use all reasonable endeavours to comply with such request.

6.2 Unless you indicate on the Submission Form that you would like your Story to be published anonymously, we will assert your moral right to be identified as the author of your Story.

6.3 We reserve the right not to publish your Story or to remove your Story from the Website at any time at our discretion.

 

7 - Contribution Tokens and Prizes

From time to time RFHE may decide to award prizes to one or more authors who submitted Stories to the Kaleidoscope Project. Such awards are at the discretion of RFHE, including in terms of value and content, and may be subject to further terms and conditions, (such as, for example, requests for further personal details, requests for a photograph or attendance at an event) as may be required by RFHE from you, and so may be awarded subject to written agreement to such additional terms and conditions.

 

8 - Administration and Communication

8.1 RFHE will administer the Project and can refuse to include any submitted Story for any reason at its sole discretion.

8.2 RFHE reserves the right to cancel the Kaleidoscope Project at any stage or for any reason at its own discretion.

8.3 You understand and agree that RFHE or any of its affiliates or partners is not responsible for any loss or damage to you or any third party in relation to the Kaleidoscope Project, to the fullest extent under the law.

8.4 RFHE takes its safeguarding obligations very seriously, and will take all actions it deems necessary to comply with any of its obligations as set out in its Safeguarding Policy which may include, where required, removal of any Story from the Website, and any reports to third parties (including the police), where it deems necessary or appropriate.

8.5 On request, this Agreement may be made available to you in your local language, if available. In the event of a dispute as to the terms of this Agreement, the English version of the Agreement shall prevail.

 

9. Privacy and other information

We will ask you to provide some personal information as part of the submission process. Disclosure of this information shall be subject to terms set out in RFHE’s Privacy Policy. All personal information held by RFHE will be held by us in accordance with the terms of applicable data protection laws including UK GDPR and as set out in RFHE’s Privacy Policy.

 

10. Withdrawal

10.1 You are entitled to withdraw your entry from the Website, by sending us notice to info@kaleidoscope-lives.eu. Where you send us notice that you would like to withdraw, we will endeavour to remove the Story from ongoing publication on any media controlled by RFHE as quickly as possible, and in any event within 10 working days.

10.2RFHE may remove a Story from any published media or the Website at any time at our discretion.

 

11. General

11.1 We reserve the right to amend these terms and conditions at any stage, if deemed necessary in our opinion.

11.2 We cannot accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any server, Internet access, system or otherwise which may result in any entry being lost or not properly registered or recorded. Proof of sending is not proof of receipt.

11.3 Where this Agreement is terminated for any reason, all provisions of this Agreement which by their nature can survive termination, shall survive termination, including without limitation, ownership provisions, warranty disclaimers and limitations of liability.

11.4 RFHE and its suppliers and licensors make no warranties of any kind, express or implied, including without limitation, fitness for a particular purpose and non-infringement, nor that the Website will be error free, nor that access to the Website be continuous or uninterrupted.

11.5 In no event will RFHE or its suppliers or licensors, be liable with respect to any claim under this agreement whatsoever, except to the extent that such limitation of liability is prohibited by applicable law.

11.6 You represent and warrant that your Story complies with the provisions of this Agreement, including but not limited to the provisions as set out in clause 4.9 that your Story will not enforce or misappropriate the copyright and intellectual property rights of any third party.

11.7 You agree to indemnify and hold harmless RFHE and its licensors, and their respective directors, offices and agents from and against any and all claims and expenses, including legal fees, arising out of your breach of this Agreement.

11.8 These terms and conditions are governed by the laws of England and Wales.

 

Appendix 1

Kaleidoscope Content Guidelines

Your Kaleidoscope entry can cover all and any aspects of your life, but we suggest that you include some of the following:

· Your relationship with the Jewish community, and how being part of the Jewish community (or not taking part) is a factor in your life.

· Personal relationships (family, friends)

· Memories of Jewish experiences – cheder, camp, Jewish school, youth movement, student group, synagogue and community life, trips to Israel, etc..

· Autobiographical (past) but also relate to this moment when you are on the cusp of adulthood and the choices you need to make for your future.

· Why being Jewish is/isn’t important to you?

· What do you like/dislike about being a young Jewish adult?

· Where do you see yourself in the future? What kind of Jewish life would you like to have as an adult?

· Has the war in Israel affected you in any way?

 

Appendix 2

Kaleidoscope Privacy and Data Protection Notice

Rothschild Foundation Hanadiv Europe (RFHE) is committed to protecting the privacy and security of your personal data. It is important that you read this notice so that you are aware of how and why we are using such personal data. This privacy notice describes how we collect and use personal data about you during and after your relationship with us, in accordance with data protection law.

Why are we doing this and how can you participate?

We are asking Jewish people from around Europe to submit an original piece of writing of between 750 and 7,500 words or other representation, to describe their Jewish experience.

Following review, qualifying Stories will be published and available to view on a dedicated website.

What personal data will RFHE collect and how will we use it?

There are two types of personal data: personal data and special category data. Special category data is still personal data, but it is processed by RFHE and requires RFHE to follow additional compliance steps.

We will use the personal data listed below to:

• administer the Kaleidoscope Website,
• obtain the relevant permissions,
• communicate with you on matters relating to the Kaleidoscope Website, and,
• if required to publish information about you and your story on the Kaleidoscope Website and perhaps on other websites and social media channels run by RFHE.

Personal data

RFHE will collect and process the following personal data about you:

• Your first name and surname
• Your date of birth
• Your email address and phone number
• Your Instagram handle (if relevant)
• Your postal address
• Your submission
• If your Story is published on the Website or elsewhere, we will also process any biographical information that you provide to us.

RFHE may also collect and process special category data about you, depending on what information you share with us, including information that may be included in the Story. This could include:

• Gender
• Racial or ethnic origin
• Religious or philosophical beliefs
• Health information

Background Checks

RFHE may also carry out further background checks on you if it reasonably deems this to be necessary, such as online and social media screening checks. RFHE will use the personal data processed as part of background checks to verify you meet the eligibility criteria. Information returned as part of a background check may not rule you out of participation in the Kaleidoscope project, but non-disclosure of such information which is later discovered may result in your exclusion from the Kaleidoscope Project.

Who is the Data Controller?

RFHE is the “data controller” of your personal data. This means that RFHE decides what your personal data is used for, and the ways in which it is processed. For the avoidance of doubt, your personal data will be collected and processed solely for the purposes set out in this privacy notice and in accordance with our Privacy Policy. As the data controller, RFHE has the responsibility to comply, and to demonstrate compliance with, data protection law.

Sharing your personal data

RFHE works with approved third-party providers who help us to provide some of our services. These partners only use your personal data on behalf of RFHE and not independently of RFHE. We currently use a third-party supplier to provide RFHE with the uploader form used for this project.

Authors’ name, age and story title may be published online on RFHE’s website and Kaleidoscope website with your consent.

Except as stated, your personal data will not be shared with any other third parties unless required or permitted by the law.

Retaining your personal data

The personal data of all the authors of all Stories published on the Website will be stored by RFHE for a period of six (6) years for regulatory and compliance purposes.

The name of the author, and title of the story submitted by all participants will be retained for six (6) years.

Stories that are published will be retained and archived in perpetuity at the Central Archives for the History of the Jewish People (CAHJP).

Your personal data will be stored in the UK, Israel and the EEA.

Your rights and more information

You have rights under data protection law:

• You can request a copy of the personal data RFHE stores about you.
• You have the right to request that we rectify any inaccurate or incomplete personal data that we hold about you.
• You have the right to ask for the personal data we collect about you to be deleted, however there are limitations and exceptions to this right which may entitle RFHE to refuse your request.
• In certain circumstances you have the right to restrict the processing of your personal data, or to object to the processing of your personal data.
• You have the right to ask that we transfer the personal data to you or to another organisation, in certain circumstances.

Updating this privacy notice

We will revise this privacy notice if there are significant changes to how we use your personal data.

Appendix 3

Access to items in Central Archives of the History of the Jewish People

a. The Central Archives of the History of the Jewish People (the “CAHJP”), is an accessible national institution that serves the general public and the research community will make every effort to make the material in the CAHJP (“the Archival Material”) accessible in digital form, in the most user-friendly and readily available manner while preserving the Archival Material for future generations and without infringing the intellectual property rights in such materials.

b. RFHE (“the Depositor”) has granted the CAHJP permission to make any use of the Archival Material at the discretion of the CAHJP and in accordance with its goals. (which may include, for the avoidance of doubt, any Stories or any other material related to Kaleidoscope that RFHE has deposited in accordance with these terms). Without derogating from the foregoing, the CAHJP is permitted to copy, reproduce, print, publish, photograph, transmit, publicly perform, create a derivative work of, make available to the public on the internet or otherwise, the Archival Material, and to convert the materials to digital format or any other format that will be developed in the future, and to store the materials through electronic or other technological means.

c. The CAHJP will ensure that the Archival Material in its digital form is made digitally accessible to researchers, students and the general public in Israel and worldwide.

d. It is hereby clarified that the granting of permission to the CAHJP as described above applies only to Archival Material whose copyrights are held by the Depositor, or to Archival Material which is directly or specifically licensed by a third party to the Depositor for inclusion in the CAHJP. The use by the CAHJP of Archival Material, the copyrights in which are held by third parties and not by the Depositor, shall be subject to the copyright laws that apply to such material, subject always to any licence granted in such Archival Material. It is hereby clarified that all permissions granted under this clause shall be deemed to have been granted as well to CAHJP’s parent, the National Library of Israel Lt (CC), which shall be entitled to use and provide access to the Archival Material in its activities.

e. The CAHJP works in cooperation with various agencies in Israel and around the world in the realms of culture, research, education and communication to disseminate the materials and knowledge contained in its collections. To this end the CAHJP will be permitted to use the Archival Material as aforesaid, whether on its own or in partnership with other entities, and will be entitled to grant permissions under the conditions specified above, to its partners, users and other parties with whom the CAHJP periodically cooperates.
